Changes to Workplace Injury Reporting
Changes to the way in which employers must report injuries from accidents at work will come into force from April 2012, reports commercial insurance specialists Alan & Thomas.
Currently, injuries that lead to a worker being incapacitated for more than three days have to be reported to the Health & Safety Executive (HSE). However, as from 6 April, subject to Parliamentary approval, employers will only have to report injuries that lead to seven days' absence from work.
"An 'over-seven-day' injury is one which is not 'major' but results in the injured person being away from work or unable to do the full range of their normal duties for more than seven days" advises Rob Gale, director of the Dorset-based broker.
"When calculating 'more than seven consecutive days' the day of the accident should not be counted, only the period after it. Any days the injured person would not normally have been expected to work, such as weekends, rest days or holidays, must be included".
The time in which employers have to report such injuries will also increase from 6 April and must be made within 15 days of the accident. However, where the incapacitation does not immediately follow the day of the accident, for example, due to the condition not being apparent until some time after the accident, the report should be made as soon as the injury or condition has incapacitated the worker for more than seven consecutive days.
"We would advise employers and those with responsibility for health and safety in organisations to still maintain a record of over three day injuries – an accident book entry will be sufficient. Having an accurate and up-to-date record of incidents and resultant injuries will play a major part should an investigation by the HSE or any claims for personal injury against the employer be initiated".
As well as reporting incidents to the HSE, employers are reminded to also notify their insurance broker so that they in turn can notify the insurer.
"Late notification of incidents is a common cause of insurers rejecting claims and in many cases, delays in notification can result in missed opportunities which can have a significant influence in terms of reducing the final cost of the claim" concludes Rob.
